BROOKLYN, NEW YORK (December 29, 2019) – A resident of Fiorentino Plaza identified as Emmett Mizell was injured in a ceiling collapse accident at the apartment located along Pitkin Avenue.
Emmett Mizell told reporters he made a request for repairs with the NYCHA after he noticed holes in the ceiling. But the issue wasn’t ever resolved.
Some time later Emmett Mizell was laying in his bed when the ceiling collapsed in on him. The victim was later evaluated and treated at the hospital.

An investigation into the ceiling collapse accident remains ongoing at this point.
Liability In Brooklyn Ceiling Collapse Accidents
Ceiling collapses may seem like a freak occurrence but they are actually fairly common. These types of accidents take place for a variety of reasons including poor construction, poor building materials and faulty engineering. Water damage, in particular, is one of the most common factors. Here are just a few of the signs to look for with respect to water leaks:
- Ceiling stains
- Swelling or bubbling
- Seating
- Mold
All property owners including the NYCHA have a legal obligation to maintain their premises in a reasonably safe manner. According to the New York State Bar, “if there is an unsafe condition (or activity) on the owned property, of which the owner knew, or should have known, and which caused injury to someone on adjacent property, the owner will be liable.” When a property owner has been aware of an unsafe condition by a tenant the are obliged to fix the unsafe condition.
Any person that is injured in a ceiling collapse accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A premises liability attorney can examine all of the facts of your case and let you know what your legal options are. It doesn’t cost anything to hire an attorney and they can work to make sure that your rights are being protected.
