Liability In Five Towns Truck Accidents
According to the NHTSA, “In 2016 there were 5,987 pedestrians killed in traffic crashes, a 9-percent increase from the 5,495 pedestrian fatalities in 2016. This is the highest number of pedestrians killed in one year since 1990.” There are a number of reasons that pedestrian accidents occur including:
- Driver fatigue
- Driver distraction
- Driver intoxication
- Speeding
- Failure to yield
A number of pedestrian accidents take place when drivers make dangerous left turns. According to New York Vehicle & Traffic Law (Sec. 1411), “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close as to constitute an immediate hazard.”
If the person driving a pickup truck was working at the time of a collision the company that they were working for could face civil liability. Under the legal doctrine of respondeat superior companies are generally liable for the negligent conduct of their employees – insofar as those employees were working within the course and scope of their job duties.
Any person that is injured in a pedestrian accident may be able to seek justice through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It’s important that evidence is properly preserved and collected after an accident. A car accident attorney can examine all of the facts of your case and let you know what your legal options are.
