Liability In Lakewood Balcony Fall Accidents
Balcony falls may seem like a freak occurrence, but they are actually quite common. According to the Committee on Injury and Poison Prevention, “Falls of all kinds represent an important cause of child injury and death. In the United States, approximately 140 deaths from falls occur annually in children younger than 15 years. Three million children require emergency department care for fall-related injuries.” Victims of balcony falls are often left with very serious injuries including:
- Bone fractures
- Head trauma
- Spinal cord injuries
- Hip injuries
- PTSD
Property owners in New Jersey have a legal responsibility to maintain their premises in a reasonably safe manner in order to prevent accidents. Active hazards should be sought out and removed. Balconies should also be periodically inspected to make sure that they are safe. When a landlord is given notice of a dangerous condition on their premises they should take measures to correct the problem.
Any person that is injured in a balcony fall may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Head injuries, in particular, can require extensive surgery costs and follow up care. A premises liability attorney can examine all of the facts of your case and let you know what your legal options are.
