Liability In Manhattan Accidents Involving Falling Ice
Accidents involving falling ice may seem like a freak occurrence but they are actually quite common. Many of these accidents are actually completely preventable. Depending on the facts of any case a property owner may face civil liability for an accident involving falling ice. Generally speaking, property owners have a legal responsibility to maintain their premises in a reasonably safe environment.
According to the New York State Bar, “if there is an unsafe condition (or activity) on the owned property, of which the owner knew, or should have known, and which caused injury to someone on adjacent property, the owner will be liable. For example, if the owner allows water to flow from his property onto adjacent property, which then freezes – forming ice, and results in a fall and injury, the owner will be liable.” If, for example, ice was falling from a building for several days and the owner failed to take measures to clear it out or warn pedestrians of the danger they could face liability for an accident.
Victims who are hit by falling ice are often left with very serious head injuries. Even a mild traumatic brain injury can leave victims with lifetime medical costs well in excess of $100,000. Any person that is injured by falling ice may be able to seek justice through a premises liability claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A premises liability attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
