Liability In Lyft and Uber Accidents
According to the MIT Technology Review, “The rise of ride-sharing services has increased traffic deaths by 2% to 3% in the US since 2011, equivalent to as many as 1,100 mortalities a year, according to a new study from the University of Chicago and Rice University.” There are a number of causes of ride-share accidents including:
- Driver intoxication
- Driver fatigue
- Speeding
- Illegal maneuvers
Rideshare drivers are supposed to operate their vehicle according to the prevailing conditions of the road. There is no good excuse for a driver to ever rear-end another vehicle. Drivers are supposed to be scanning the road ahead of them and maintain a safe follow distance with the lead vehicle. If a Lyft or Uber driver rear-ends another car and causes an accident they will typically be held liable.
Whether or not Lyft or Uber are liable for an accident will depend on what the driver was doing at the time of the collision. If the rideshare driver did not have the app on and was not picking up or dropping off a passenger Lyft or Uber typically wouldn’t be liable. If the driver was picking up or dropping off a passenger at the time of the collision Lyft or Uber normally would face some liability for the accident.
Any person that is injured in a car accident due to the negligent conduct of a Lyft or Uber driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. There are, however, statute of limitations associated with civil claims. It is therefore important to act quickly. A rideshare accident attorney can examine all of the unique facts of your case free of cost and let you know what your legal options are.
