A second school bus was called to the scene and the rest of the students were taken to the Taconic Hills School. Other students were evaluated by the school nurse when they got to school.
An investigation into the school bus accident remains ongoing at this point.
Liability In Taghkanic School Bus Accidents
According to USA Today, “U.S. drivers were involved in 340,039 fatal motor vehicle traffic crashes, according to the National Highway Traffic Safety Administration (NHTSA). Of those, 1,214, or just .4%, were classified as “school-transportation-related.” For the most part school buses are extremely safe. In fact, students are around 70 times safer going to school in a bus instead of a car. But accidents still happen for a variety of reasons including:
- Distracted driving
- Inclement weather
- Icy conditions
School buses are considered common carriers according to the law. As common carriers school bus drivers have a heavy burden to operate their vehicles safely. According to Squaw Valley Ski Corporation v. Superior Court, “The elevated standard of care for common carriers is “based on a recognition that the privilege of serving the public as a common carrier necessarily entails great responsibility, requiring common carriers to exercise a high duty of care towards their customers.” If there is ice on the road, bus drivers should slow down accordingly. Victims of bus accidents are often left with very serious injuries including:
- Head trauma
- Spinal cord injuries
- Traumatic brain injuries
- Broken bones
Traumatic brain injuries can be particularly expensive. Even a mild traumatic brain injury can leave victims with medical bills in excess of $85,000 with more serious injuries costing as much as $3,000,000. Symptoms of traumatic brain injuries may include:
- Problems with speech
- Difficulty sleeping
- Loss of consciousness
Victims of school bus accidents may be able to collect damages through a bodily injury claim. Damages can include compensation for medical bills, lost wages and pain and suffering. School buses that can carry at least 16 or more students are required by FMCSA regulations to carry at least $5,000,000 worth of liability insurance. A school bus accident attorney can examine all of the facts of your case and let you know what your legal options are.
