Liability In Brooklyn Truck Accidents
Truck drivers have a heavy responsibility to operate their vehicles in a reasonably safe manner. A fully loaded semi-truck can weigh as much as 80,000 lbs. They can be very difficult to stop and to maneuver. All drivers of class 8 trucks must get a commercial license and undergo extensive training. There are a number of factors commonly associated with fatal truck accidents including:
- Brake problems
- Prescription drug use
- Traveling too fast for conditions
- Unfamiliarity with roadway
- Roadway problems
- Over-the-counter drug use
- Inadequate surveillance
- Fatigue
If any person fails to drive reasonably safe and hits a pedestrian they could face civil liability. According to NYS Vehicle and Traffic Law (VTL), §1146, “every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” Violators of this provision may face “a fine of not more than five hundred dollars or by imprisonment for not more than fifteen days or by both such fine and imprisonment.”
If a truck driver was working at the time of an accident the company that they were working for could face vicarious liability. The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills, funeral expenses and loss of love. There are, however, statute of limitations associated with civil claims. A truck accident attorney can examine all of the facts of your case and get you the answers that you deserve about what went wrong.
