Car accidents remain one of the leading causes of premature death in the United States. According to the IIHS, “There were 34,247 fatal motor vehicle crashes in the United States in 2017 in which 37,133 deaths occurred. This resulted in 11.4 deaths per 100,000 people and 1.16 deaths per 100 million miles traveled.” There are a number of factors commonly associated with car accidents including:

All drivers have a legal obligation to operate their vehicles according to the prevailing conditions of the road. For example, if there is inclement weather or reduced visibility drivers should slow down. Driving the speed limit could be dangerous depending on the prevailing conditions. It’s important that evidence is properly preserved and collected after an accident.
If the at fault driver of an accident was working at the time of the collision the company that they were working for could be held at fault. Under the doctrine of respondeat superior, “an employer or principal legally responsible for the wrongful acts of an employee or agent, if such acts occur within the scope of the employment or agency. Typically when respondeat superior is invoked, a plaintiff will look to hold both the employer and the employee liable.”
The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a wrongful death claim can help cover lost wages, medical bills, funeral expenses and loss of love. Potential beneficiaries in a civil dispute may include a victim’s spouse, children, parents or siblings. A car accident attorney can investigate all of the unique facts of your case and let you know what your legal options are.
