Driver Injured In Niagara Falls Truck Accident By Niagara Falls Boulevard and Military Road
NIAGARA FALLS, NEW YORK (December 1, 2019) – One person was injured in a truck accident after their car became pinned underneath a tractor trailer on Niagara Falls Boulevard and Military Road.
Niagara Falls police are saying that the accident took place around 8:00 a.m. on Sunday Morning. For reasons that remain under investigation a car hit the side of a semi-truck as it was making a left-hand turn onto Military Road.
Paramedics arrived to the scene of the accident near Popeyes Chicken and Sunoco gas station. The top of the sedan involved in the accident was sheared off and the car was wedged underneath the tractor trailer.
Firefighters were eventually able to remove the driver of the car and they were taken via ambulance to the hospital. The semi-truck driver remained at the scene and cooperated with authorities.
Roadways all across Western New York were covered with snow and ice after a large storm in the early morning hours. An investigation into the Niagara Falls truck accident remains ongoing at this time.
Liability In Niagara Falls Truck Accidents
Over 4,000 people are killed every year in semi-truck accidents. Tens of thousands more are seriously injured. No one factor is ever solely to blame for an accident. According to one FMCSA truck accident causation study, “Fatigue, drinking alcohol, and speeding are major factors in motor vehicle crashes overall. Although their presence does not always result in a crash, these three factors, as well as other driver, vehicle, and environmental factors, can increase the risk that a crash will occur.” Truck drivers should be especially cautious during times of inclement weather.
All drivers are supposed to yield the right of way to oncoming vehicles before making left turns. According to New York Vehicle & Traffic Law (Sec. 1411), “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close as to constitute an immediate hazard.” The only way a driver would typically not be held at fault for a left-turn accident would be if they had a green arrow. Victims of semi-truck accidents often suffer from very serious and costly injuries including:
- Broken Bones
- PTSD
- Head Injuries
- Internal Injuries
- Lacerations
- Rib and Torso Injuries
- Seat Belt Injuries
- Spinal Cord Injuries and Paralysis
It’s important that evidence is properly documented and collected after a semi-truck accident. Most intersections are typically equipped with cameras. Any person that is injured in a truck accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. FMCSA regulations require commercial trucks to carry between $750,000 to $5,000,000 depending on the type of cargo they are carrying. A truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
