Liability In Brooklyn Motorcycle Accidents
According to the Insurance Information Institute, “Early estimates from the Governors Highway Safety Association (GHSA) show that motorcyclist fatalities in the United States are expected to have decreased by 5.6 percent in 2017 compared with 2016, a reduction of approximately 296 fatalities. The GHSA preliminary estimates are based on data from state traffic record systems.” There are a number of factors commonly associated with motorcycle accidents including:
- Distracted driving
- Driver fatigue
- Driver intoxication
- Dangerous left hand turns
Drivers are supposed to yield the right of way to motorcyclists, other vehicles and pedestrians before making left turns. According to New York Vehicle & Traffic Law (Sec. 1411), “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close as to constitute an immediate hazard.” Drivers that hit motorcyclists while making left turns will typically be found at fault.
