Liability In MTA Train Accidents
The MTA has a legal responsibility to maintain their premises in a reasonably safe manner in order to prevent accidents. This includes removing active hazards from train stations. There are a number of potential sources of danger at a train station including:
- Cracked or uneven floors
- Wet floors
- Train platforms without safety barriers
Even if a pedestrian is standing directly on the tracks the engineer has an obligation to slow down and use their horn to try to avoid hitting the victim. The family of any victim that dies in a MTA train accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, funeral expenses, medical bills and loss of love.
