Liability In Akron Semi-Truck Accidents
Generally speaking, truck accidents are usually caused by a combination of different factors. According to the FMCSA, ” Elements that influence the occurrence of a crash may take place hours, days, or months before the crash. They include driver training and experience, vehicle design and manufacture, highway condition and traffic signaling, and weather conditions. Other elements may take place immediately before a crash, such as a decision to turn in traffic, a tire blowout, or snow.” In particular, semi-trucks tend to have very large blind spots that can obscure the location of pedestrians.
All truck drivers have a legal responsibility to exercise due care in order to avoid hitting pedestrians. According to New York Vehicle Code 1146, “If such driver of a motor vehicle causes physical injury while failing to exercise due care in violation of subdivision (a) of this section, then there shall be a rebuttable presumption that, as a result of such failure to exercise due care, such person operated the motor vehicle in a manner that caused such physical injury.” Truck drivers are held to a very high standard in terms of safety. Victims of semi-truck accidents tend to suffer from very serious and costly injuries including:
- Broken bones
- Spinal cord injuries
- Organ damage
- Head trauma
- PTSD
Any person that is injured in a semi-truck accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. The FMCSA requires commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage depending on what they are carrying. Unfortunately, truck companies will often fight vigorously to deny liability for any accident. A truck accident attorney can examine all of the facts of your case free of cost and let you know what your legal options are.
